What is the difference between an “uncontested” divorce and a “contested” divorce?

An uncontested divorce means that both spouses have reached an agreement on ALL the issues even down to who gets the couch and who gets to keep what bank account. If you all have a disagreement about ANYTHING including child support, you DO NOT have an uncontested divorce.

A contested divorce means that you both want a divorce but you have not agreed on all the issues and you will need a judge to decide the issues that you both cannot agree to. There is no such thing as “I have an uncontested divorce but the only issue is child support.” – your divorce is CONTESTED then.

Know the difference. Unless both parties will sign a divorce settlement agreement, be prepared to go to court.
